Terms and Conditions

1. Definitions:

ALVA PC: A trading name of Anode & Cathode (us, the supplier)
We or Us: Anode & Cathode Ltd
Customer: You and Your
Consumer: Any individual buying goods from us for private use.
Goods: The computer hardware goods and sold by us to the customer, additional documents attached to the goods are also included
Software: Computer operating systems or applications

2. Orders

The specification of the computer goods we sell contain the hardware and software specified by the consumer, additional software or hardware is not included unless specifically ordered or otherwise stated on the order page, this includes floppy drives, CD/DVD burning software. We reserve the right to change Products (incl. 3rd Party Products) at any time, but we guarantee equivalent or superior functionality and performance.

You can place an order by adding the product or products that you want to order to your cart, proceeding to the checkout and then following the on-screen process. Once placed, an automated email confirming receipt of your order will be sent to you. If you do not receive this within 12 hours of placing your order, please check your spam. If you still cannot locate the email, contact us by sending an email to sales@alvapc.co.uk to check that we have received your order. Our email confirming despatch of your order constitutes acceptance of your offer to buy (“order”) and will form a legally binding contract between us and you for the sale of the products, governed by these terms.

3. Price & Payment

VAT is included in the prices shown on our website and we also do not charge for delivery so there are no hidden costs whatsoever. We will only send out the goods once full payment has been received and cleared.

4. Delivery

The delivery estimation given is only an approximate guideline and has no bearing on the contract between ALVA PC and you. We are entitled to deliver orders in instalments in the event that particular components are out of stock. The place of delivery is stated in the Order Confirmation, in the event that the order has been dispatched and requires to be redirected to a different address, a £9 charge is applicable to the purchaser. Risk of the loss of the goods passes to you on delivery.

When signing for goods being delivered, you must be content that the goods have arrived in uncontaminated condition, if this is unreasonable the delivery note must be signed for as “non-signed”, otherwise transit insurance would be void and the customer would be responsible for repair costs. When you receive good/s you must review it for any defects within 3 days. After this period the goods are conclusively deemed as accepted and claims of transit damage cannot be upheld.

5. Warranty

ALVA PC warrants that goods at the time it is delivered will be free from defects in workmanship and the materials of the goods will correspond in all aspects with the relevant product specification.

ALVA PC guarantees that all goods will be free from defects for 36 months from the day it is delivered and if any goods sold by us do not correspond to this warranty then we have the option to fix the defect in question, replace the goods or refund the consumer. Unauthorised returns will be rejected. If goods need to be returned, then we will provide an RMA number and arrange courier collection. Any repairs conceded which are found to be outside the terms of this warranty will be charged to the purchaser and will be payable at the point of service.

The purchaser must make sure the environmental and power supply conditions are suitable for the equipment, and that the equipment is sustained in line with the manufacturers instructions and recommendations.

Warranty is invalid if certain components have been upgraded by the user, and we have reason to believe this has had a direct effect on the failure of a part supplied by us. In this instance the customer would be responsible for labour costs.

It is the purchaser’s responsibility to back up all operating systems, applications and data in the event that the good/s has to be sent back to the manufacturer for fault diagnoses, repair and test.

Exclusions

Software and Operating Systems. Breakdowns or failures arising from any external influences such as misuse, neglect, excessive wear to the equipment and other external influences such as, but not limited to, poor environmental conditions, electrical power surges, power failure, the use of incompatible or uncertified accessories or media (pirate copies) and the effect of computer viruses.

The replacement of any parts classed as consumables, such as floppy disks, tapes, magnetic media of any type and batteries.

Any consequential loss or liability of any kind to the purchaser caused by any decisions or actions made during or after the period when the services were delivered.

6. Refunds

Any goods sold by us that is found to be faulty within the first 30 days of receipt can be returned to us for a full refund, but we must be notified via our website’s return procedure or you can email us at sales@alvapc.co.uk. For a full refund to be processed the goods must be returned in their original condition, along with all CDs, manuals and packaging. If the PC is found not to be faulty or is outside the scope of our warranty, then you may be charged for collection and re-delivery or a cancellation charge may apply. For this reason, please make sure that the faults you have diagnosed are not due to incompatibility or software issues.

Distance Selling Regulations (DSR) state that a customer has the right to cancel the order without giving a reason up to 14 working days starting the day after delivery. The consumer has a duty of care for the products during this period. You can examine the goods as you would in a shop but to obtain a full refund you must not start using them, install them or input any data/software. The goods must be returned in ‘as new’ condition and in their original packaging and the products should be returned at the expense of the buyer. Any software supplied that has been “opened” becomes the property of the customer and is non-refundable, the retail price of the software would be deducted from any refund due.

Returned goods must be well packaged, preferably in their original box. If goods are not returned in their original packaging, we cannot be held responsible for the damage during transportation to our workshop and during transportation back to the customer, and a courier claim will be void.

7. Repair

Any problem with goods sold by us that is reported to us within 30 days of receipt will be collected and returned to the purchaser free of charge, if no fault is found or if it is software related then the purchaser will be charged for collection and redelivery.
Turnaround time ranges from 4 – 14 working days and you will be contacted once the goods have been diagnosed and we will inform you whether or not you are entitled to a full refund or replacement.

8. Data Protection

Your data will be held and/or transferred in strict accordance with the applicable data protection laws. Your details will not be transferred to third parties.

Note: English law and the exclusive court jurisdiction of the English courts will apply to this Agreement
